Electricity Storage Network response to the environmental permitting consultation

At a glance

The Electricity Storage Network has submitted a detailed response to Defra’s consultation on including battery energy storage in environmental permitting regulations. We have been working with Defra on these proposals since 2023 and welcome the opportunity to provide input via this consultation.

We support strong regulation that protects communities and the environment. However, the current proposals risk delaying critical battery storage projects at a time when the UK urgently needs to expand deployment levels to deliver Clean Power 2030.

Our response, based on input from members and our industry working groups, outlines the sector’s active work on fire safety, best practice and offers clear recommendations for how government can achieve its aims without creating unnecessary delays or costs.

Key recommendations

  • Environmental permitting may not be the right tool. The proposed regime is slow to implement, details are lacking and misaligned with the fast-moving technology innovation in the battery storage sector.
  • Stronger standards don’t have to mean slower progress. The ESN recommends alternatives like BSI PAS standards or licence conditions that can provide reassurance more quickly.

If the government proceeds with this route, we recommend that they make the regime flexible and proportionate:

  • Align new rules with existing best practices
  • Ensure costs and processes are clear and manageable
  • Avoid penalising existing sites – apply retrospective rules carefully
  • Regularly update BAT/GET to reflect technology changes
  • Ensure consistent policy across England, Wales and Scotland
  • Align environmental permitting with planning and fire safety guidance
  • Reflect international standards already used by industry.
